EXIGE Inc. Terms of Service

1. Terms

By accessing the website at https://exige.ca, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

1. Permission is granted to temporarily download one copy of the materials (information) on EXIGE Inc.’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on EXIGE Inc.’s website;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or “mirror” the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by EXIGE Inc. at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Gift Certificates

1. Gift Certificates (GC) are sold subject to these Terms and Conditions and by purchasing a Gift Certificate from EXIGE MEDI SPA (EXIGE Inc.) you will be deemed to have read and accepted our Terms of service and Conditions.
2. Gift Certificates ordered through our website will be delivered automatically by electronic means to the email address you specify at the time of order.  Our Gift Certificates include unique numbers and configurable patterns.
3. Gift certificates are non refundable, non transferable, have no cash value, are not insurance eligible, and cannot be combined with any other offer.
4. A valid government issued ID (driver’s license, passport) must be presented and must match recipient’s name.
5. All gift certificates sold on https://www.exige.ca are quoted in Canadian dollars – CAD.
6. The total value of the card must be redeemed at once. Any unused balance will be converted into service credits exclusively for the gift certificate’s recipient and can only be used at EXIGE MEDI SPA.
7. We cannot accept responsibility for the loss or theft of Gift Certificates. Gift Certificates are not replaceable if lost, damaged, stolen or expired and are void if altered, photocopied or reproduced. 
8. A Gift Certificate cannot be used to purchase a further Gift Certificate.
9. If your use of Gift Certificates raises any tax liability on you, including disclosure, then such liability is your sole responsibility.
10. We cannot be held responsible if the email address is entered incorrectly and someone other than the intended recipient receives and uses the Gift Certificate (please carefully check spelling when entering email addresses).
11. Site offers and promotions (including gifts with purchase and discounts) do not apply when purchasing gift certificates.
12. You can check the balance of the Gift Certificate by logging into your account (please note, this only applies if you register for an account).
13. All gift certificates are subject to the governing laws of Alberta and the Calgary courts shall have exclusive jurisdiction in relation to any disputes.
14. We strongly encourage you to familiarize yourself with the Alberta Fair Trading Act at the following:

15. Further, EXIGE Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
16. Should you have any questions, concerns and requests regarding Gift Certificate Terms and Conditions please do not purchase until you fully understand them or contact us for clarification.

4. Disclaimer

1. The materials on EXIGE Inc.’s website are provided on an ‘as is’ basis. EXIGE Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, EXIGE Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall EXIGE Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on EXIGE Inc.’s website, even if EXIGE Inc. or a EXIGE Inc. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6. Accuracy of materials

The materials appearing on EXIGE Inc.’s website could include technical, typographical, or photographic errors. EXIGE Inc. does not warrant that any of the materials on its website are accurate, complete or current. EXIGE Inc. may make changes to the materials contained on its website at any time without notice. However EXIGE Inc. does not make any commitment to update the materials.

EXIGE Inc. has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by EXIGE Inc. of the site. Use of any such linked website is at the user’s own risk.

9. Governing Law

These terms of service and conditions are governed by and construed in accordance with the laws of Calgary, Alberta and you irrevocably submit to the exclusive jurisdiction of the Alberta courts of Canada.
